You agree to the transfer of the personal information and order data provided by you to third parties who have been fully or partially commissioned by Tobian Soundsystems to process your order. Tobian Soundsystems only passes on data or information or parts of data or information that was made available in the course of processing your order and that must be passed on in the interest of effective and expedity processing.

Your product will be delivered exclusively in Switzerland. On request, however, a delivery can also be organized abroad at the expense and risk of the buyer. Tobian Soundsystems does not offer its own delivery of the goods. A shipment is carried out in each case by commissioned transport companies. The transfer of risk takes place by handover to the respective carrier/forwarder.

The delivery fees and conditions depend on the nature of the items ordered. If you want delivery by express, CHF 20.- will be charged. Forwarding costs for other special delivery requests of the customer depend on the price list of the corresponding transport company.

The purchase price is due in full 14 days after invoicing. After the expiration of 14 days at the latest, the buyer is in default without further reminder.

A direct purchase via the website www.tobian-soundsystems.com is not possible. In particular, the information provided there is not legally binding offers for the conclusion of a purchase contract. An order can be placed directly on site, by email or by phone. A contract for the goods desired by the buyer is only concluded when Tobian Soundsystems accepts the order in writing with the inclusion of these GTC (see acceptance of your order).

Unannounced price changes reserved. Changes will take effect with the update of this web content. Tobian Soundsystems assumes no responsibility for typographical errors and errors.

In the event of unauthorized refusal to accept the items delivered by us, we reserve the right to charge the customer for the costs and activities incurred. Our right to fulfill the purchase contract remains unaffected by this.

If a package cannot be delivered by post, it will be stored at the responsible post office for 7 days. If the package is not picked up, it goes back to Tobian Soundsystems. In the event of a necessary second delivery, Tobian Soundsystems is entitled to charge the customer for this.

Tobian Soundsystems Corporation offers a 2-year warranty against defects in materials or workmanship. If your product does not satisfy you in accordance with the warranty conditions, please contact Tobian Soundsystems Customer Service 0800 880 022 or write to tobian@tobian-soundsystems.com.

Please note that Tobian Soundsystems is only liable for consequential damages due to intentional or grossly negligent actions of Tobian Soundsystems. Used goods such as goods from mediation as well as custom-made products according to customer-specific wishes are excluded from exchange, conversion or return as well as liability at Tobian Soundsystems.

The order acceptance and the fulfillment of the contract between you and Tobian Soundsystem take place when you have received an order confirmation from Tobian Soundsystems. Your order may not be accepted if one of the following cases exists:

The product you ordered is not (anymore) in stock.

An error has occurred in connection with the pricing or product identification.

All goods remain the property of Tobian Soundsystems, and the buyer does not acquire any ownership rights in products until all sums due for the relevant products including shipping, freight costs and any other costs related to the purchase or delivery of the products in question have been paid in full.

The customer is not entitled to re-sell the goods to third parties before full payment and thus before the transfer of ownership of the goods to the customer.

Our business activities and thus the relationship between customer and Tobian Soundsystems are based exclusively on Swiss law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

For customers with domestic and/or foreign residential or The company’s registered office is the registered office of Tobian Soundsystems, place of performance and enforcement as well as the exclusive place of jurisdiction for all proceedings.

Should one of the provisions contained herein not become part of the contract for any reason or is legally invalid, the validity of the remaining provisions, which do not become part of the contract, will come closest to the legal provision.

Tobian Soundsystems reserves the right to change the terms and conditions at any time.
